View Full Version : Should prison experience affect sentencing?

So I was in court the other day, and there was a man of Arabian descent who had a slight mental illness that made him steal useless things (i.e. toilet paper + cleaning supplies). He spent 165 days in pretrial custody, and plead guilty to trying to evade police (high speed chase) and theft under $5000. His lawyer argued that his prison experience was much worse than a normal persons, because other inmates spat on him and called him a terrorist (this occured at the courthouse as well). He was put into solitary sometimes to avoid this abuse, and was transferred prisons as well.
As a result of this, his sentence was dead time (the time he already served waiting for trial) + 1 day to go get his property.
Should a shitty prison experience like this affect his sentencing? On one hand, he was subject to abuse and racism, but on the other, prison IS a punishment and is not meant to be fun.

wow, good question, no i dont think it should, if you cant handle the way prison is gonna be for you dont do the shit to get in there, though this ugy has a mental illness, so he should probably be given special treatment, lock him up in an asylum or something

I say if intentionally fuck up. Too bad, prison isnt supposed to be easy. Simple as that. Anyone who feels sorry for someone who fucked someone elses life is a moron.

Heres another way to look at it, it is the job of the prisons and the government while you are in their custody to prevent this sort of abuse...does their failure to live up to standards set out in the CCRF mitigate the sentence at all?

for people with disabilities, they should have like a house arrest or be locked up in an asylum

If the inmates health is poor or they are at risk then yes something should be done as they have that right.

its their responsibility yes, but if shit does happen, it shouldnt affect the sentence because, shit happens, thats the thing

yes and no because I think the people being ridiculed or attacked should have the same sentence, but the people doing it should stay there longer.

in this guy's case, i think it was fair (just because retarded people are endearing), but usually, yeah, prison shouldn't be fun, so just suck it up.
